2.3 Sensitive Categories

Some information you provide — including assessment responses related to mental health, substance use, and sexual function — may be considered sensitive personal information under applicable law. We treat such information with appropriate care and comply with CCPA/CPRA and other applicable state privacy laws. We do not use sensitive personal information for purposes other than those necessary to provide the Services, as required by law, or as you have specifically consented to.

4. How We Share Information

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including payment processors, hosting providers, email delivery services, analytics providers, marketing platforms, audio hosting services, voice synthesis providers, fraud prevention services, and professional advisors. These providers are bound by contractual obligations to use information only as necessary to perform services for us.

4.2 Business Transfers

If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred to a successor entity. We will notify you of any such change.

4.3 Legal Requirements

We may share information when required by law, legal process, or governmental request, or to protect our rights, property, safety, or that of our users.

4.4 Aggregated and De-Identified Data

We may share aggregated, anonymized, or de-identified information that does not reasonably identify you with partners, advertisers, and the public for any business purpose without restriction.

4.5 What We Do NOT Do

We do not sell your personal information to third parties for their independent marketing purposes.

We do not share your assessment responses, audio listening history, or other sensitive use data with advertisers, marketing partners, or affiliate partners. Affiliate marketing (Section 5) does not involve transferring your personal data to partners — you remain in control of whether to share information with them.

5. Affiliate Marketing and Partner Offers

5.1 How It Works

We participate in affiliate and referral programs with third-party companies whose products or services we believe may interest our users. When we recommend a partner product — in emails, on our website, or in your dashboard — we may include an affiliate link. When you click such a link, you are taken to the partner's own website. Your personal information is not transferred to the partner when you click a link. You decide whether to engage with the partner and share information with them directly. We may receive a commission or referral fee if you make a purchase.

5.2 Disclosures

Per FTC Endorsement Guide requirements, we disclose affiliate relationships in marketing materials, emails, and on our website where required.

5.3 Opting Out

You can opt out of marketing emails containing affiliate offers at any time using the unsubscribe link in any email or via your account settings. Opting out of marketing emails does not affect transactional emails.

6. Cookies and Tracking

We use cookies, pixels, session storage, and similar technologies to maintain sessions, authenticate users, analyze traffic, measure marketing performance, and detect fraud. You can manage cookies through your browser settings, though disabling some may affect functionality. You may opt out of third-party advertising cookies at optout.aboutads.info.

7. Data Security

We use commercially reasonable safeguards including HTTPS encryption, password hashing, and access controls. No internet transmission or storage system is completely secure. We cannot guarantee absolute security.

8. Data Retention

We retain personal information as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion per Section 9.

9. Your Privacy Rights

Depending on your location, you may have rights to know, access, correct, delete, and port your personal information, and to opt out of certain uses. California residents have additional rights under CCPA/CPRA. Washington residents have rights under the My Health My Data Act regarding consumer health data collected through our assessment and program use.

To exercise your rights, email [email protected] with your name, account email, and request. We respond within the time required by applicable law.

You may opt out of the sharing of personal information for cross-context behavioral advertising by contacting us at the privacy email above.

10. International Users

The Services are operated from the United States. By using the Services, you consent to the transfer and processing of your information in the United States.

11. Children's Privacy

The Services are not intended for individuals under 18. We do not knowingly collect information from children. Contact [email protected] if you believe a child has provided us information.

12. Third-Party Links

The Services may contain links to third-party websites. We are not responsible for their privacy practices. Review their policies before sharing information with them.
