1. Acceptance of Terms
By accessing or using this website, mobile applications, audio programs, subscriptions, memberships, downloadable content, streaming services, coaching materials, assessments, or any related services (collectively, the "Services") provided by MindSciences.org ("Company," "we," "us," or "our"), you agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Website Disclaimer, all of which are incorporated by reference.
If you do not agree to these Terms, do not access or use the Services. These Terms constitute a binding contract between you and the Company. By creating an account, completing the assessment, or accessing any audio content, you affirm that you have read, understood, and accepted these Terms.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- Your use of the Services does not violate any applicable law or regulation
- You are not located in a jurisdiction where the Services are prohibited
- You are not on any U.S. government list of prohibited or restricted parties
The Services are intended for use within the United States. If you access the Services from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.
3. Subscription Services and Recurring Billing
3.1 Automatic Renewal
The Services are offered on a recurring subscription basis, including monthly, annual, promotional, trial, discounted, installment, or other recurring billing arrangements.
By subscribing, you expressly authorize the Company and our payment processors to automatically charge your designated payment method on a recurring basis (monthly or annually, as selected) until you cancel in accordance with these Terms.
Your subscription will continue and renew automatically until canceled. The subscription term, renewal frequency, and current pricing are displayed at the point of purchase and in your account dashboard.
3.2 Introductory and Promotional Pricing
We may offer introductory pricing, promotional discounts, free trials, reduced-rate memberships, founding member rates, or other temporary offers. Unless otherwise expressly stated at the point of sale:
- Promotional and introductory pricing is temporary
- At the end of the promotional period, your subscription will automatically renew at the then-current standard rate
- The renewal price may be higher than the introductory or promotional price
- You authorize recurring billing at the standard rate after the promotional term expires unless you cancel before the next renewal
3.3 Pricing Changes
We reserve the right to modify subscription prices, plans, benefits, or billing periods at any time. Material price changes will be communicated to active subscribers at least 30 days in advance by email, and will take effect on the next renewal date unless you cancel before that date.
3.4 Payment Methods and Failed Payments
You must provide a valid payment method and keep your billing information current. If a payment method fails, expires, or is declined, we may retry the charge, suspend access until payment is received, or terminate your account and subscription.
3.5 Taxes
Subscription prices may not include applicable sales, use, or other taxes. You are responsible for any taxes assessed in connection with your purchase.
4. 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee on initial subscription purchases.
4.1 Eligibility for Refund
To be eligible for a refund under this guarantee:
- The request must be submitted within 30 days of your initial subscription purchase
- The guarantee applies to first-time subscribers only (not renewals, reactivations, or repeat purchases)
- The request must be submitted in writing to [email protected]
- You must include your account email and order reference
4.2 How to Request a Refund
Email [email protected] within 30 days of your initial purchase with subject "Refund Request" and your account email. Refunds are typically processed within 5–10 business days to the original payment method.
4.3 Limitations
The 30-day money-back guarantee applies only to the initial subscription purchase amount. It does not apply to subsequent renewals, additional purchases, gift subscriptions, or charges after the initial 30-day period. It may be denied in cases of suspected fraud, chargeback abuse, account sharing, or violation of these Terms. We reserve the right to limit refunds to one per customer.
4.4 After the 30-Day Period
- Payments are non-refundable except as required by applicable law
- Partial billing periods are not prorated
- Unused subscription time is forfeited upon cancellation
5. Cancellation Policy
5.1 How to Cancel
You may cancel your subscription at any time from your account dashboard at https://mindsciences.org/dashboard or by emailing [email protected]. No phone call is required.
5.2 When Cancellation Takes Effect
Cancellation prevents future billing cycles but does not retroactively refund prior charges (except as provided under Section 4). When you cancel, you retain access through the end of your current paid period, after which your subscription will not renew.
5.3 Reactivation
You may reactivate your subscription at any time. The Money-Back Guarantee in Section 4 does not apply to reactivated subscriptions.
6. No Medical or Psychological Advice
6.1 Educational Purpose Only
The Services are provided solely for educational, motivational, entertainment, relaxation, mindfulness, self-improvement, and personal development purposes. The Services are not, and shall not be construed as:
- Medical treatment, diagnosis, or care
- Psychotherapy, psychological counseling, or psychiatric care
- Prescription, monitoring, or supervision of any medication

6.2 No Medical Claims

7. Hypnosis, Relaxation, and Audio Content Safety
7.1 Nature of Content
Certain programs use techniques including clinical hypnosis, guided visualization, meditation, deep relaxation, breathwork, affirmations, cognitive and behavioral methods, and acceptance-based techniques.
7.2 Prohibited Use — Never use audio while:
- Driving, operating a vehicle, or as a passenger requiring alertness
- Operating machinery, tools, or equipment
- Performing any task requiring full attention or quick reflexes
- Supervising children, dependents, or vulnerable persons
- Performing hazardous activities or safety-critical work
7.3 Medical and Psychological Contraindications
Consult a qualified healthcare professional before using the Services if you have or have had: epilepsy or seizure disorders, severe mental illness (including schizophrenia or psychotic disorders), bipolar disorder in an active phase, dissociative disorders, severe PTSD or complex trauma, active suicidal ideation, active psychosis, or any condition for which a provider has advised against relaxation or hypnosis.
7.4 Discontinue If Adverse Reaction
If you experience distress, dissociation, panic, flashbacks, or any adverse reaction, discontinue use immediately and seek appropriate professional assistance. In an emergency, call 988 or 911.
8. No Results Guaranteed
8.1 Variability of Outcomes
We make no representation, warranty, or guarantee regarding personal transformation, habit change, addiction recovery, sleep improvement, anxiety reduction, weight management, sexual confidence or function, athletic or professional performance, or any specific outcome of any kind.
8.2 Individual Variation
Individual results vary significantly based on personal commitment, underlying health conditions, concurrent treatment, life circumstances, and other factors outside our control. Any outcomes referenced in marketing, testimonials, or program descriptions represent individual experiences and are not typical or guaranteed.
8.3 Complementary, Not Replacement
The Services are intended to complement, not replace, professional care. Behavioral and wellness outcomes typically require sustained personal effort and may require professional supervision and additional support.
9. User Responsibility and Acknowledgments
You acknowledge and agree that:
- You are solely responsible for your decisions, actions, and the consequences thereof

- You can stop the audio at any time and resume normal awareness
- You are responsible for evaluating whether the Services are appropriate for your situation
- You will not use the Services in lieu of necessary medical or psychological care
- You will inform your healthcare providers of your use of the Services if relevant
10. Intellectual Property
10.1 Ownership
All content, including audio recordings, video, scripts, written materials, graphics, branding, logos, software, interfaces, downloads, course materials, methodology, assessments, and related content ("Content") is owned by the Company or licensed to the Company and is protected by U.S. and international intellectual property laws.
10.2 Limited License
We grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Content for your own personal, non-commercial use during the term of your subscription, subject to these Terms.
10.3 Prohibited Uses
- Reproduce, copy, distribute, or republish any Content
- Resell, sublicense, rent, lease, or commercially exploit Content
- Publicly perform, broadcast, or transmit Content
- Modify, adapt, translate, or create derivative works of Content
- Reverse engineer, decompile, or extract source materials
- Use Content to train machine learning or AI models
- Use Content for any purpose competitive with the Company
10.4 User Submissions
If you submit testimonials, reviews, or other content to us, you grant the Company a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute such submissions in any media for any business purpose, including marketing.
11. Account Sharing and Personal Use
Subscriptions are licensed to a single individual user. You may not share your account credentials, permit others to access the Services using your account, create multiple accounts to circumvent restrictions, or use the Services on behalf of any business or organization without a separate license. We may suspend or terminate accounts engaged in credential sharing, unauthorized distribution, piracy, or other abuse.
12. Limitation of Liability
12.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EMOTIONAL, PSYCHOLOGICAL, MEDICAL, FINANCIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.3 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12.4 Jurisdictional Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
13. Assumption of Risk
You expressly assume all risks associated with use of the Services, including risks associated with hypnotic suggestion and relaxation, risks of attempting behavioral or lifestyle change, risks of emotional or psychological responses to audio content, and risks of relying on the Services in lieu of professional care.
14. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its owners, officers, directors, employees, contractors, agents, licensors, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use or misuse of the Services, your violation of these Terms, your violation of any applicable law or third-party right, or any content you submit to us.
15. Termination
15.1 Termination by You
You may terminate your account at any time by canceling your subscription per Section 5 and contacting [email protected] to request account deletion.
15.2 Termination by Us
We reserve the right to suspend, restrict, or terminate your access at any time, with or without notice, for any reason, including violation of these Terms, fraud, chargeback abuse, account sharing, illegal activity, or discontinuation of the Services. Upon termination, your license to access the Content immediately ends. Sections that by their nature survive (including 8, 10, 12, 13, 14, 16, 17, 18, 19, and 20) will survive termination.
16. Dispute Resolution and Arbitration
16.1 Informal Resolution
Before initiating any formal dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 60 days.
16.2 Binding Arbitration
Any dispute arising from or related to these Terms or the Services that cannot be resolved informally shall be resolved exclusively through final and binding arbitration administered by JAMS or the American Arbitration Association (AAA) under their rules then in effect, conducted in the State of California.
16.3 Class Action Waiver
You and the Company agree that any dispute shall be brought in an individual capacity only and not as a plaintiff or class member in any purported class, collective, representative, or consolidated action.
16.4 Opt-Out
You may opt out of this arbitration provision by sending written notice to [email protected] within 30 days of first accepting these Terms, including your full name, email address, and a clear statement that you wish to opt out.
17. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. For any dispute not subject to arbitration, the exclusive venue shall be the state or federal courts located in Los Angeles County, California.
18. Electronic Communications and Consent
By creating an account, you consent to receive electronic communications from us, including transactional emails, service announcements, and required legal notices. You may separately consent to marketing communications, which you can opt out of at any time via the unsubscribe link in any marketing email or in your account settings.
19. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated by posting revised Terms with a new "Last Updated" date, sending an email to active subscribers, and displaying a notice on the Services. Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, cancel your subscription per Section 5.
20. Miscellaneous
20.1 Entire Agreement
These Terms, together with the Privacy Policy and Website Disclaimer, constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements.
20.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
20.3 No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
20.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
20.5 Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, pandemic, government action, or internet failures.
